25 Years of IIRIRA: A Horrible Legacy of White Supremacist and Deeply Xenophobic Immigration Law
The following is a joint statement from Presente.org and Alianza Americas in response to the 25 year anniversary of the Illegal Immigration Reform and Immigration Responsibility Act of 1996 (IIRIRA):
“25 years ago, one of the worst laws you’ve probably never heard of, IIRIRA, calcified an immigration system based on punishment, restriction, and exclusion.This draconian law has severely curtailed due process for immigrants, supercharged deportations, and has allowed local law enforcement agencies to serve as immigration agents. Laws rooted in white supremacy have no place in our nation,” said Matt Nelson, executive director of Presente.org. “Immigrant communities continue to make countless contributions to our country and our immigration laws should reflect our values of inclusion, freedom, and belonging. It’s past time for IIRIRA to have been repealed, and for Congress to have passed a new generation of immigration policies deeply anchored on the vastly positive economic, social, cultural, and political impact immigrant communities have had in the U.S., as well as in their countries of origin. It is our duty to protect peoples’ freedoms and human rights. And when we deny families that freedom, we’re threatening freedom itself.” concluded Nelson.
“Twenty-five years ago, on September 30, 1996, former President Clinton signed into law the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRIRA). Over the last quarter century, this racist immigration law has fueled the mass detention and deportation apparatus that has ripped millions of families apart, leaving countless communities devastated. Sadly all these years later, Congress has failed to change course and to adopt immigration policies reflective of the vastly positive role immigrants have played in the U.S. Regretfully, IIRIRA institutionalized the view of immigrants, asylum seekers and refugees as a threat to the nation. The way we treat them, to this day, continues to be consistent with this outdated and inhumane legislation. As organizations committed to creating an inclusive, equitable and sustainable way of life for migrant communities living in the United States and across the Americas, we’ll continue organizing to ensure legislators once and for all leave behind the profoundly racist and xenophobic immigration laws now in place,” said Oscar Chacon, executive director of Alianza Americas.

IIRIRA: 25 años de una ley de inmigración profundamente xenófoba y que exalta la supremacía blanca
A continuación, un pronunciamiento conjunto de Presente.org y Alianza Americas en respuesta al 25 aniversario de la Ley de Reforma de Inmigración Ilegal y Responsabilidad de los Inmigrantes (IIRIRA, por sus siglas en inglés), de 1996:
“Hace 25 años, una de las peores leyes de las que probablemente nunca se haya oído hablar, IIRIRA, calcificó un sistema de inmigración basado en el castigo, la restricción y la exclusión. Esta ley draconiana ha restringido severamente el debido proceso para las personas inmigrantes, ha sobrecargado las deportaciones y ha permitido que cuerpos locales de policía sirvan como agentes de inmigración. Las leyes basadas en la supremacía blanca no deberían tener cabida en nuestro país,” dijo Matt Nelson, director ejecutivo de Presente.org. “Las comunidades inmigrantes continúan haciendo innumerables contribuciones a nuestro país y nuestras leyes de inmigración deben reflejar nuestros valores de inclusión, libertad y pertenencia. Ya es hora de que IIRIRA sea derogada y que el Congreso apruebe una nueva generación de políticas de inmigración profundamente ancladas en el impacto económico, social, cultural y político enormemente positivo que las comunidades de inmigrantes han tenido en los EE. UU., así como en sus países de origen. Es nuestro deber proteger las libertades y los derechos humanos de los pueblos. Cuando negamos a las familias esa libertad, estamos amenazando la libertad misma”, concluyó Nelson.
“Hace veinticinco años, el 30 de septiembre de 1996, el ex presidente de los Estados Unidos Bill Clinton promulgó la Ley de Reforma de Inmigración Ilegal y Responsabilidad de los Inmigrantes de 1996 (IIRIRA). Durante el último cuarto de siglo, esta ley de inmigración racista ha alimentado el aparato de detención masiva y deportación que ha destrozado a millones de familias, dejando a innumerables comunidades devastadas. Lamentablemente, todos estos años después, el Congreso no ha cambiado de rumbo ni ha adoptado políticas de inmigración que reflejen el papel enormemente positivo que han desempeñado las personas inmigrantes en los EE. UU. Lamentablemente, IIRIRA institucionalizó la visión de los inmigrantes, los solicitantes de asilo y los refugiados como una amenaza para la nación. La forma en que los tratamos, hasta el día de hoy, sigue siendo coherente con esta ley pública obsoleta e inhumana. Como organizaciones comprometidas con la creación de una forma de vida inclusiva, equitativa y sostenible para las comunidades inmigrantes que viven en los Estados Unidos y en todo el continente americano, continuaremos organizándonos para garantizar que los legisladores dejen atrás de una vez por todas las leyes de inmigración profundamente racistas y xenófobas que ahora están en vigor”, dijo Oscar Chacón, director ejecutivo de Alianza Americas.
